Where the obligation comes from

The obligation was not born of a fashion for surveillance: it came from a concrete problem of unpaid overtime and the difficulty of proving it. Understanding its origin explains why the rule insists so hard on the word "daily".

Article 34.9 of the Workers' Statute

Royal Decree-Law 8/2019 added a paragraph 9 to article 34 of the Spanish Workers' Statute obliging employers to guarantee a daily record of working time for the whole workforce.

The obligation came into force on 12 May 2019, two months after the decree-law was published.

Why "daily" and not monthly

The rule requires the record to include the specific start and end time of each worker's day. A monthly total, or the contractual schedule, does not meet that requirement.

The reason is evidential: without the daily figure you cannot establish whether working time was exceeded on a given date, which is precisely what the reform set out to fix.

Who is covered

It reaches the whole employed workforce, whatever their grade, contract type or whether they work part or full time.

Specific figures fall outside it, such as senior executives under Royal Decree 1382/1985, who have their own special employment relationship.

What an auditor usually asks for

  • Evidence that the record is daily, not monthly
  • Coverage of the whole workforce, including part-time contracts
  • Recording of remote workers too
  • Recording arrangements agreed by collective bargaining or prior consultation
